See, I have to disagree with you, basing my judgment almost entirely on the stark contrast between The Joker from the sitcom and The Joker as portrayed by Nicholson. If that could be managed, and the role was still humor-filled, think about the extremes to which the new Joker was taken, and expand on that concept for The Penguin.
There is always a way to darken any character almost beyond original recognition. Trust me on that.

I desperately want to see some of the more awesome villans like Catwoman, Penguin and Poison Ivy make appearances; yet I also want to see justice for Robin and Batgirl. Ellen Page from Juno seems like she'd be geeky enough to try Batgirl, but I'm not sure about anyone else. Despite the fact I read Entertainment Weekly, I'm not that on the ball when it comes to the A-List now actors. I'm surprised I remembered Ms. Page, as I've never even seen Juno. *shrugs*

I think it can be done as long as they're careful. There is that fine line that could just tip it over into cartoon absurdity the way the previous franchise did.
I've just been watching Batman Unmasked: The Psychology of the Dark Knight on History Channel, and they talked about the villains in psychological terms, which made them sound more legitimate: Penguin = beurocracy gone mad, Riddler = extreme narcisism, etc.
I read a pretty interesting online article about that very topic the other day... I can't remember the link, but it was basically the writer giving odds for how likely the various villains were to appear in the next Nolan movie.

There are certain villains I think are just too silly to be effectively reinvented for this new, darker franchise.
